These Terms of Service ("Terms") govern your use of swifthomebuyersus.com (the "Site") and any related services offered by Swift Home Buyers LLC ("Swift Home Buyers," "we," "us," or "our"). By accessing the Site, submitting a form, or otherwise interacting with us, you agree to these Terms. If you do not agree, do not use the Site.

You must be at least 18 years old and legally able to enter into a contract to use the Site. By using the Site, you represent that you meet this requirement.

If you are submitting information about a property, you represent that you are either the owner of the property, a co-owner, a legal representative (such as an executor or trustee), or otherwise authorized to discuss a potential sale.

Swift Home Buyers is a real estate solutions company. We help homeowners in Florida explore options for selling a single-family home, including:

• Cash offers — we or an affiliated buyer may purchase your home directly.
• "Max Value Option" home sales — we coordinate a sale on your behalf, generally targeting higher net proceeds than a typical cash offer.
• Situational guidance — we help match you to the best path based on your circumstances, such as an inherited home, tired landlord, fixer-upper, or relocation.

Swift Home Buyers is not a licensed real estate brokerage, and we do not represent you as a real estate broker. We may be a principal in the transaction (that is, the buyer), or we may refer or assign opportunities to third-party buyers, investors, joint-venture partners, or licensed brokers. You are free at any time to engage your own broker, attorney, or other advisor.

Nothing on the Site or in any communication from us is legal, tax, accounting, or financial advice. Consult your own professionals before making decisions about your property.

Any preliminary estimates, ranges, or examples on the Site are illustrative only, do not represent an offer to buy your property, and do not guarantee the price you will receive.

Any formal offer we extend is subject to:

• Verification of property details, ownership, and title.
• Inspection, whether interior or exterior, as applicable.
• Market conditions.
• Our underwriting and discretion.

We may decline to make an offer for any reason or no reason, consistent with applicable law.

When you submit a form on the Site or through a Meta Instant Lead Form connected to our advertising:

• You authorize us to contact you about your property and services.
• You confirm the information you provide is accurate to the best of your knowledge.
• You agree to our use of that information in accordance with our Privacy Policy.

Providing a phone number or submitting a form does not by itself enroll you in text messages. You may submit any Site form without agreeing to receive SMS messages. If you do not select the optional SMS checkbox, we may still respond through other contact methods you provide, subject to applicable law and your communication preferences.

If you affirmatively select an optional, unchecked SMS consent box, you agree to receive automated customer-care text messages from Swift Home Buyers LLC. Messages may concern your property or investment inquiry, a requested offer or information, appointments or walkthroughs, transaction updates, and related follow-ups. This consent does not authorize promotional or marketing texts.

You agree that:

• All property information you provide is accurate and complete to the best of your knowledge.
• You authorize us to verify your property details using public records, including county assessor, tax, MLS, and deed records.
• You will not submit information about a property you do not own or are not authorized to sell.

We may decline to proceed if the information you provide is materially inaccurate or incomplete.

Submitting a form on the Site or a lead form on our advertisements does not create a binding agreement to sell your property. Any purchase or sale must be confirmed through a separate written purchase agreement signed by both parties. Nothing on the Site constitutes an offer to purchase real estate.

You agree not to:

• Use the Site for any unlawful purpose.
• Submit false, misleading, or fraudulent information.
• Attempt to access non-public areas of the Site, servers, or systems.
• Scrape, crawl, copy, or reverse-engineer the Site, except as allowed by law.
• Upload malware or interfere with the Site's operation.
• Impersonate another person or misrepresent your authority.

We may suspend or terminate your access to the Site for any violation of these Terms.

All content on the Site, including text, graphics, logos, photos, videos, design, and code, is owned by Swift Home Buyers or its licensors and is protected by copyright, trademark, and other laws. You may not copy, modify, distribute, or create derivative works without our prior written permission, except for personal, non-commercial use of publicly displayed pages.

The Swift Home Buyers name and logo are our trademarks. You may not use them without our permission.

The Site may contain links to or embed services from third parties, including Meta, Google, payment processors, and mapping providers. We do not control and are not responsible for the content, terms, or practices of those third parties. Your interactions with third-party services are governed by their own terms.

THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OPERATION, TO THE FULLEST EXTENT PERMITTED BY LAW.

We do not warrant that any offer, estimate, or information on the Site is accurate, complete, or up to date. Property values and market conditions change.

TO THE FULLEST EXTENT PERMITTED BY LAW, SWIFT HOME BUYERS, ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES arising out of or in connection with your use of the Site or any services, even if advised of the possibility of such damages.

Our total aggregate liability to you for any claim arising out of or related to the Site or these Terms is limited to the greater of (a) $100 or (b) the amount you have paid us in the 12 months before the claim, which is typically $0 because our Site and lead intake are free.

Some jurisdictions do not allow certain limitations of liability, so the above may not apply to you.

You agree to indemnify, defend, and hold harmless Swift Home Buyers and its affiliates, officers, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses, including reasonable attorneys' fees, arising out of (a) your use of the Site, (b) your violation of these Terms, (c) your violation of any third-party right, including any intellectual property or privacy right, or (d) any inaccurate or false information you submit.

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law principles. Any dispute arising out of or related to these Terms or the Site will be brought exclusively in the state or federal courts located in Duval County, Florida, and you consent to personal jurisdiction in those courts.

At our option, any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site may be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration will be held in Duval County, Florida. You and Swift Home Buyers each waive the right to a jury trial and the right to participate in any class action.

You may opt out of this arbitration provision by sending written notice to Swift Home Buyers LLC,900 Cesery Blvd, Ste 102, Jacksonville, FL 32211, within 30 days of first accepting these Terms.

We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. Continued use of the Site after changes are posted constitutes your acceptance.

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. These Terms, together with our Privacy Policy, are the entire agreement between you and Swift Home Buyers regarding the Site.
